1. AGREEMENT AND ACCEPTANCE

1.1 Binding Agreement

The website in.cabiotourism.com (the “Website”) is owned and operated by CABIOLIMO LLC, trading as Cabio Tourism (“Company,” “we,” “us,” or “our”), with its registered office at MRZ Complex, MP12/369A, Street 28, Kannur, Kerala, 670325, India. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” or “you”) and the Company.

1.2 Acceptance of Terms

By accessing, browsing, using, or booking services through this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any provision contained herein, you must immediately discontinue use of our services.

1.3 Additional Terms

Specific tour packages, accommodations, or services may be subject to additional terms and conditions provided by third-party suppliers (hotels, airlines, transport operators, activity providers). Such additional terms are deemed incorporated by reference into these Terms.

2. DEFINITIONS AND INTERPRETATION

  • “Service Provider” means any third-party supplier of travel services including hotels, airlines, transport operators, and activity providers.
  • “Travel Services” refers to all tourism products and services offered through the Website, including tours, transfers, accommodations, and activities.
  • “Booking Confirmation” means the electronic document confirming your reservation details and payment.
  • “Force Majeure” means any event or circumstance beyond the Company’s reasonable control, including but not limited to natural disasters (earthquake, flood, cyclone, landslide), epidemic or pandemic, fire, war, civil unrest, strikes, government action or travel restriction, or unforeseen supplier cancellation (hotel, airline, transport).
  • “Tour Cost” means the total published price payable by the Customer for the booked Travel Service, inclusive of applicable taxes unless stated otherwise.

3. ELIGIBILITY AND USER RESPONSIBILITIES

3.1 Age Requirements

You must be at least 18 years of age to use our services or make bookings. Users under 18 may only use our services under the direct supervision and responsibility of a parent or legal guardian.

3.2 Account Security

Users are responsible for maintaining the confidentiality of their account credentials and all activities that occur under their account, and must immediately notify us of any unauthorized use.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during the booking process, including valid identification and contact details, and to update such information as necessary.

4. BOOKING AND PAYMENT PROCEDURES

4.1 Booking Process

All bookings are subject to availability and confirmation by relevant Service Providers. A booking is only confirmed upon receipt of our Booking Confirmation email or message.

4.2 Payment Methods

We accept UPI, major debit/credit cards, net banking, and other payment modes as made available on the Website, in Indian Rupees (INR). All prices displayed include applicable taxes (including GST, where applicable) unless otherwise specified.

4.3 Pricing Policy

All prices are subject to change without notice until full payment is received. Published rates may fluctuate due to currency variations, fuel surcharges, or changes in supplier pricing, and any such increase must be settled by the Customer prior to departure.

4.4 Payment Security

All payment transactions are processed through secure, encrypted payment gateways. Customers must retain copies of all transaction records for their reference.

5. CANCELLATION AND REFUND POLICY

5.1 Customer-Initiated Cancellations — Cancellation Charges

If you cancel a confirmed booking, the following cancellation charges (as a percentage of the total Tour Cost) will apply based on the number of days before the scheduled departure date on which we receive your written cancellation request:

Cancellation charges are calculated on the total published Tour Cost, exclusive of non-refundable third-party costs such as visa fees, insurance premiums, and any air tickets already issued, which are additionally forfeited as actually incurred.

5.2 Administrative / Processing Fee

In addition to the cancellation charge above, a tiered administrative fee applies to the refunded amount to cover payment gateway and processing costs:

5.3 How to Cancel

Cancellation requests must be submitted in writing via email to india@cabiotourism.com from the email address used for booking, or through WhatsApp/telephone confirmed in writing. The cancellation date is the date on which we receive your written request, not the date of any earlier verbal communication.

5.4 Company-Initiated Cancellations, Force Majeure and Natural Disasters

Where the Company cancels, postpones, or is unable to operate a confirmed booking due to a Force Majeure event — including natural disasters, extreme weather, pandemic-related restrictions, government advisories, or unforeseen supplier cancellation — the Company will, at its discretion:

  • Offer to reschedule the booking to an alternative date at no additional administrative charge, subject to availability and any change in supplier pricing; or
  • Issue a non-encashable Credit Note for the amount paid (less any non-recoverable costs already incurred with suppliers such as hotels, airlines, or activity operators), valid for use against a future booking within 12 months; or
  • Where the Company is able to recover the corresponding payment from its Service Providers, refund the recovered amount in cash to the Customer’s original payment method, less any bank or gateway charges actually deducted.

Because the Company pre-pays hotels, transport, and other suppliers to secure a booking, a cash refund in Force Majeure situations is not guaranteed and is limited to what the Company is able to recover from the relevant Service Providers. The Company will make reasonable efforts to pursue such recovery on the Customer’s behalf and will keep the Customer informed of the outcome.

This clause does not apply to cancellations initiated by the Customer for personal reasons, which remain governed by Clause 5.1 above.

5.5 No-Show and Mid-Tour Discontinuation

If a Customer fails to present themselves at the designated pick-up point or departure time (“No-Show”), or voluntarily discontinues, leaves, or terminates a tour after it has commenced for any personal reason, this will be treated as a deemed cancellation and no refund of any kind will be payable, regardless of the reason. Where discontinuation is due to a documented medical emergency, the Company will provide reasonable assistance in arranging return travel, but the associated costs remain the Customer’s responsibility.

5.6 Refund Processing

Approved refunds will be processed within 10–14 business days to the original payment method, after deduction of applicable cancellation charges, administrative fees, and any non-recoverable third-party costs. Processing times beyond this may occur depending on the Customer’s bank or payment provider and are outside the Company’s control. No interest is payable on any refunded amount.

5.7 Modification Requests

Requests to change travel dates, destinations, or the number of travelers on a confirmed booking are subject to availability and Service Provider approval, and may incur additional charges as determined by the Service Provider, plus the tiered administrative fee set out in Clause 5.2. A modification that amounts to a substantially different tour package will be treated as a cancellation and rebooking under Clause 5.1.

5.8 Group Bookings (10 or more travelers)

Group bookings of 10 or more travelers are subject to the following additional terms:

  • A deposit of 30% of the total group Tour Cost is payable upon confirmation, with the balance due 30 days before the scheduled departure date.
  • Changes to group size, itinerary, or travel dates must be communicated at least 14 days in advance and are subject to availability and additional charges.
  • Group cancellation charges follow the slab in Clause 5.1, applied to the deposit and any payments made; the non-refundable deposit component may be forfeited in full for cancellations made within 30 days of departure.

6. TRAVEL DOCUMENTATION REQUIREMENTS

6.1 Identification and Travel Documents

Customers are solely responsible for carrying valid government-issued photo identification (Aadhaar, PAN, passport, driving licence, voter ID, or other accepted proof) as required for domestic travel, and valid passports and visas for any international travel component. Visa application fees, once processing has begun, are non-refundable.

6.2 Health and Safety Requirements

Customers must comply with all health, safety, and government regulations applicable to their chosen destinations and activities, including any regulatory identity verification (KYC) requirements applicable to travel and hospitality bookings in India.

7. TRAVEL INSURANCE

We strongly recommend that all customers purchase comprehensive travel insurance covering medical emergencies, trip cancellation, lost baggage, and other travel-related incidents. Cabio Tourism does not provide travel insurance and is not responsible for costs incurred due to inadequate or absent insurance coverage. Where a specific package mandates insurance, proof of coverage must be provided before departure.

8. ITINERARY CHANGES AND WEATHER-RELATED MODIFICATIONS

Tours and activities may be modified, curtailed, or cancelled due to adverse weather, seasonal restrictions, local safety conditions, or Force Majeure. In such cases the Company will offer alternative arrangements, rescheduling, or a partial credit at its discretion, consistent with Clause 5.4. The Company is not liable for losses arising from circumstances beyond its reasonable control, including natural disasters, government action, civil unrest, or pandemic-related restrictions.

9. PHOTOGRAPHY, MARKETING AND MEDIA RIGHTS

9.1 Photography Consent

By booking our services, Customers consent to being photographed or filmed during tours and activities for marketing, promotional, and social media purposes, unless they opt out in writing as described below.

9.2 Usage Rights

The Company reserves the right to use Customer photographs, videos, testimonials, and reviews in its marketing materials, website, social media, and promotional campaigns, without additional compensation.

9.3 Opt-Out

Customers who do not wish to be included in marketing materials must notify us in writing at the time of booking or before the tour begins, at india@cabiotourism.com.

10. LIMITATION OF LIABILITY AND DISCLAIMERS

10.1 Service Provider Relationship

Cabio Tourism acts as an intermediary/facilitator between customers and independent Service Providers (hotels, airlines, transport operators, activity providers). We are not liable for the acts, omissions, negligence, or default of any Service Provider.

10.2 Limited Liability

Our liability, to the maximum extent permitted by applicable Indian law, is limited to the value of services purchased. We shall not be liable for indirect, consequential, special, or punitive damages arising from your use of our services or participation in any tour.

10.3 Website Availability

While we strive to maintain continuous availability of the Website, we are not liable for temporary interruptions, technical difficulties, or maintenance that may affect access to our services.

10.4 Third-Party Content

We are not responsible for the accuracy, completeness, or reliability of third-party content, links, or advertisements appearing on the Website.

11. INTELLECTUAL PROPERTY RIGHTS

All Website content, including text, images, logos, graphics, and tour descriptions, is proprietary to the Company and protected under applicable Indian intellectual property law. Content may only be used for personal, non-commercial purposes; commercial use, reproduction, or distribution without express written consent is strictly prohibited.

12. PRIVACY AND DATA PROTECTION

Our collection, use, and protection of your personal information is governed by our separate Privacy Policy, available at in.cabiotourism.com/privacy-policy, which is incorporated by reference into these Terms. By using our services, you also consent to receive booking-related and, where opted in, promotional communications by email, SMS, or WhatsApp, from which you may opt out at any time.

13. REGULATORY COMPLIANCE

The Company complies with all applicable Indian laws governing travel and tourism services, including consumer protection regulations, applicable tax and GST requirements, and identity-verification (KYC) norms. The Company reserves the right to decline service to any individual where required to comply with applicable law, including anti-money-laundering and sanctions-related obligations under Indian law.

14. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 Applicable Law

These Terms and all related disputes shall be governed by and construed in accordance with the laws of India.

14.2 Jurisdiction

Subject to Clause 14.3, the courts at Kannur, Kerala, India shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or your use of our services.

14.3 Alternative Dispute Resolution

We encourage customers to first contact our customer service team to resolve any concerns before pursuing formal legal action or approaching a consumer forum.

15. MODIFICATIONS AND UPDATES

The Company reserves the right to modify these Terms at any time. Updated Terms will be posted on the Website with the effective date indicated. Continued use of our services following any amendment constitutes acceptance of the revised Terms.

17. SEVERABILITY AND ENFORCEABILITY

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision does not constitute a waiver of our right to enforce it in future.

By booking services through in.cabiotourism.com, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
